U.S. Mines Complete Safest Year Ever

Last year was the safest year ever for American miners. Both coal mines and metal/non-metal mines last year recorded the fewest fatalities in the history of American mining. Total mine fatalities fell below the previous record set in 2008, and nearly 85 percent of all U.S. mines completed the year with no lost-time injuries.

"We’re gratified by this achievement because it confirms that safety is a core value at U.S. mines with the use of advances in technology, risk analysis, enhanced training and a heightened emphasis on safety awareness," said National Mining Association President and CEO Hal Quinn. "Our work, however, continues as we strive to reach our ultimate goal of zero injuries in America’s mines."

The official figures, issued yesterday by the U.S. Mine Safety and Health Administration, show 34 fatalities for all U.S. mining in 2009, 18 fewer than 2008. The 18 coal mine fatalities recorded last year were the fewest ever for U.S. coal mines, and the 16 fatalities in mineral mining in 2009 were also a record low for that sector.

U.S. mining has invested more than $850 million over the last four years to improve mine safety and to implement the Mine Improvement and New Emergency Response Act and the recommendations of the independent Mine Safety Technology and Training Commission, which was set up by NMA in 2006. During 2009, NMA launched a series of safety initiatives to reduce accidents by targeting three high-incident environments: proximity to mobile underground equipment, slips and falls and vehicle safety. Training and awareness materials developed by NMA and its members were widely distributed throughout U.S. mining.

Industry observers also noted the sustained, decade-long trend in year-over-year reductions in the rate of lost-time injuries, i.e., reported injuries per 200,000 hours worked. "The steady decline in lost-time injuries that began in 2000 underscores that heightened vigilance, advances in safety technologies and new training techniques are paying important dividends," Quinn concluded.

EPA Industry to Reduce Size

The U.S. Environmental Protection Agency is calling on Charleston, W.Va. coal operators to reduce size and impact of strip mines to gain permit approval, the The Charleston Gazette reports.

The EPA and other federal agencies including the Army Corps of Engineers are increasingly under the scrutiny of the industry and coalfield politicians after increased review of Clean Water Act permits for surface coal mining. The Department of Environmental Protection says limits on increasing regulations are quickly being realized.

"Things are unlikely to ever be the same," said Tom Clarke, director of the DEP Division of Mining and Reclamation. "We don’t know quite where things are going to end up, but you can be assured in the future the surface mines that are permitted will be smaller."

Ginger Mullins of the Corps’ Huntington district office said that 23 of the 79 permits originally targeted by EPA for these more thorough reviews were in West Virginia. Two of those applications have been withdrawn, she said.

Only one of the remaining 21 applications has actually received EPA and Corps approval. In that case -- concerning Patriot Coal’s Hobet 45 permit -- EPA pushed the company to cut its stream impacts in half, while maintaining 91 percent of its projected coal production, The Charleston Gazette reports.

The Association of Equipment Manufacturers closed 2009 with more than 800 member companies that produce and market equipment, products and services used worldwide in the agriculture, construction, forestry, mining and utility sectors. The international trade group, which provides business-development resources for the off-road equipment manufacturing industry, announces the latest companies that have been approved for membership.

Cloud Peak Energy Negotiates Contract With Decker Coal

Cloud Peak Energy Inc. announced an agreement that Decker Coal Co., in which Cloud Peak Energy is a 50% partner, has accepted a buy-out offer from an eastern utility company for a coal supply contract originally scheduled through 2012.

The customer’s contract accounted for approximately 30 percent of production for 2010 and the majority of the production for 2011 and 2012. The arrangement is mutually beneficial to both the utility and the Decker joint venture, as it allows the utility to avoid purchasing coal it no longer requires, and Decker to pursue more favorable sales opportunities. Decker Coal Co. currently holds no firm sales contracts beyond 2011, but continues to seek market opportunities for the approximately 42 million tons of non-reserve coal held by the company.

This arrangement provides financial compensation for the remaining tons under this contract and allows the Decker joint venture to better manage the ongoing mining operation. The transaction will be effective and reflected in fiscal year 2009.

New Mine in Development in W.Va.

Massey Energy Company has begun the development of a new metallurgical coal mine within its Rowland reserve in Raleigh County, W.Va. The Rowland reserve consists of 56 million tons of mostly low- and mid-volatile metallurgical coal and is located adjacent to Massey's existing Marfork operation. The new mine is the first among several that are planned to be combined in a new mining group on the Rowland reserve. Massey estimates that the new resource group will eventually produce as much as 2 million tons of metallurgical coal annually and employ over 500 miners. Massey first announced its intent to develop this reserve during a conference call with investors on Oct. 28, 2009.

Commenting on the new project, Massey's Chairman and CEO Don Blankenship said, "We have the required permits in hand for the development of the slope and shaft into the main deep mine in the Beckley seam and we are now moving forward as quickly as possible.  The development of this property further enhances our position as Central Appalachia's largest coal producer and one of the largest met coal producers in the country."

Massey acquired most of the Rowland reserve in 1998 and added to it with several small acquisitions in 2008.  Initial development of the property and construction of the mine is expected to be completed in time for the 2011 export season.

Coal Mine Launched

Americas Energy Co., British Columbia, and Americas Energy Co., Knoxville, Tenn., have begun operations on its Highway 92 surface mine project. AECo is in the process of being acquired by AENY. The property is permitted for 3 seams of coal, the Upper Rooster, Lower Rooster and the Dean. All are high-grade specialty coal seams and are anticipated to sell in the $70-80 dollar range per ton, at current coal prices. AECo is currently negotiating a sales contract for its initial monthly production of 10-12,000 tons of coal, to be delivered on a 15-month contract with Blueflame Coal located in Knoxville.

"The Highway 92 property is representative of the exceptional quality of the coal properties that the Evans Coal Corp. has assembled over the last 15 years. Combined with the Upland Church property our total monthly production will be increased to approximately 25,000 tons," said Chris Headrick, president and co-CEO of AECo. "AECo also owns a Proven Reserve of more than 4.57 million tons of coal in Bledsoe County, Tenn. where we have recently completed the required overburden drilling on the coal property and are moving forward with our engineers to obtain a surface mine permit. The property includes two seams of coal, the Richland and the Sewannee. The Sewannee is very desirable high volatile metallurgical grade coal and should command a premium price in the market."

Also, AECo is seeking qualified contract deep miners for our Kelliokae and Darby seams for our deep mine permits on the Cardinal property adjacent to our Upland Church project. Interested parties should email our COO, Sam Johnson at sjohnson@americasenergycompany.com for additional information.

Patriot Coal receives Hobet 45 Permit

Patriot Coal Corp. announced that the U.S. Army Corps of Engineers has finalized its evaluation process and issued the Hobet 45 permit under Section 404 of the Clean Water Act. The Hobet surface mine is part of the Company's Corridor G mining complex in southern West Virginia. At full production capability, the complex produces nearly four million tons of thermal coal annually.

"We are pleased that we can now begin work in the permitted area. Production at the Hobet mine is very important to Patriot, our employees and the surrounding community," said Patriot CEO Richard M. Whiting. "We appreciate the work done by the EPA and the Corps to achieve this result. We would also like to acknowledge the efforts of Congressman Nick J. Rahall, Gov. Joe Manchin, the West Virginia Congressional delegation and our locally elected representatives in support of a constructive dialogue with the EPA and the Corps that led to the issuance of this permit."
