PHMSA
hazmat fee will stay unchanged
Based on revised estimates of unexpended balances from previous
years and revenues expected to be generated at current hazardous
materials registration fee levels, the Pipeline and Hazardous Materials
Safety Administration (PHMSA) has decided that an increase is not
necessary to fund the national Hazardous Materials Emergency
Preparedness (HMEP) grants program at its authorized level of
$28,318,000 for fiscal year 2009. Therefore, the agency is withdrawing
the notice of proposed rulemaking published May 5, 2008 (73 FR 24519).

ATA
seeks action to control energy speculation
In an effort to mitigate dramatic spikes in fuel prices similar to
those in 2008, the American Trucking Associations (ATA) has called on
Congress to increase the transparency of futures markets and impose
reasonable aggregate position limits on energy commodities.
Commercial
vehicle inventory levels reach a 41-month low
Class 5-7 retail sales were off 54 percent from May 2008, but
continued low production output has reduced inventory levels to a
41-month low. However, the inventory-to-sales ratio (IN/RS) in the
medium-duty market is now at seven months, more than double normal
levels. The trend is similar in the Class 8 market, where retail sales
fell 52 percent from May 2008, but the IN/RS ratio is only 3.4 months.

announced that safety belt use by drivers of medium- and heavy-duty
commercial vehicles increased to 72% in 2008. That is up 7 percentage
points from 65% the previous year.

the US House Transportation and Infrastructure Committee and its

Price
of diesel fuel drops for first time in two months
The average price of diesel fuel nationwide dropped for the first
time in eight weeks, decreasing 0.8 cents to $2.608 a gallon, according
to US Department of Energy information.

business development for Heil Trailer International (HTI). Most recently
vice-president–Asia Pacific, he is assuming responsibility for the
company’s South American operations. JOEL FERNANDES JR has been
appointed managing director for Heil Brazil. He brings experience in
management, marketing, and sales, holding senior sales management
positions with international companies in the medical devices and
industrial products industries.
Veteran transportation attorney FREDERICK R “FRITZ” DAMM was
presented the Transportation Lawyers Association’s Lifetime
Achievement Award at the organization’ annual meeting recently. Damm
is a partner in the Detroit MI office of Scopelitis, Garvin, Light,
Hanson & Feary. He was previously chairman of the North American
Transportation Employee Relations Association and continues to serve on
its board of directors.
