Online merchants have dodged another bullet when it comes to
the Fair and Accurate Credit Transactions Act (FACTA). In the recent
case Shlahtichman v. 1-800 Contacts, Inc., a judge in the
Northern District of Illinois ruled in December that FACTA does not
apply to electronic displays or e-mail confirmations of Internet
transactions.

A recent survey of 1,000 marketers by ExactTarget finds that
companies will spend more on digital media this year than they did in
2009 — 17% more on average, to be precise. The study reveals that the
