Macy's Looking for the Sweetest Tweet

Macy's is the latest merchant to launch a contest that will incorporate its Twitter channel - It's giving away one 1/4 karat diamond daily to the person who sent the "sweetest tweet" that includes the hashtag #SweetestTweet, and a three-stone diamond anniversary ring on Feb. 14 to one grand prize winner. Ruling: FACTA Does Not Extend to E-Commerce Confirmations

Online merchants have dodged another bullet when it comes to the Fair and Accurate Credit Transactions Act (FACTA). In the recent case Shlahtichman v. 1-800 Contacts, Inc., a judge in the Northern District of Illinois ruled in December that FACTA does not apply to electronic displays or e-mail confirmations of Internet transactions.

A recent survey of 1,000 marketers by ExactTarget finds that companies will spend more on digital media this year than they did in 2009 — 17% more on average, to be precise. The study reveals that the online channel likely to get the biggest increase in marketing budget this year is the one that's the hardest to measure, with the worst-understood ROI: social media.
