FDA Letter to P&G Marks Agency’s Fourth Drug-Dietary Supplement Combo Warning
November 3, 2009

After retracting its warning letter to Procter & Gamble on October 14 and blaming a computer error for its release, the U.S. Food and Drug Administration (FDA) formally issued another warning on October 29 notifying the company that its Vicks DayQuil Plus Vitamin C and Vicks NyQuil Plus Vitamin C are being illegally marketed as “drug-dietary supplement” combination products. The FDA considers the Vicks products misbranded because their labels do not identify vitamin C as an active drug ingredient. Read More.

From Industry to Congress, Support Builds for Allowing Drug-to-Supplement Switch for New Ingredients
November 3, 2009

Co-chairs of the Congressional Dietary Supplement Caucus wrote to the U.S. Food and Drug Administration (FDA) on October 22 asking the agency to allow supplement manufacturers to seek its approval for ingredients that were the subject of unsuccessful new drug applications. The Congress members—Democrats Jared Polis of Colorado and Robert Wexler of Florida and Republicans Jason Chaffetz of Utah and Dan Burton of Indiana—asked the FDA to make use of a dormant section of the 1994 Dietary Supplement Health and Education Act (DSHEA) that allows for companies to seek the FDA’s approval for new dietary supplement ingredients that had been clinically studied for potential drug applications. Sanofi-Aventis Plans Plunge into China’s Vitamin and Mineral Market with New Joint Venture
November 3, 2009

The French pharmaceutical company Sanofi-Aventis announced in late October that it intends to form a joint venture with the Minsheng Pharmaceutical Group to make vitamin and mineral products for the Chinese market. The agreement marks Sanofi-Aventis’s first foray into China’s burgeoning over-the-counter (OTC) product market—which Oliver Charmeil, the company’s senior vice president for pharmaceutical operations in Asia/Pacific and Japan, said is expected to become the world’s second largest OTC market by next year. Minsheng Pharmaceutical Group, which is based in Hangzhou, currently produces the most popular supplements in China, the 21-Super Vita multivitamin-multimineral tablets. Sanofi-Aventis will own a majority share in the joint venture; other financial details were not disclosed. Read More.

Perrigo Flying High Despite Losing Leiner Bidding War Last Year
November 3, 2009

Perrigo Co.—one of the top-five supplement sellers in the United States, according to Nutrition Business Journal sales estimates—announced record earnings for the first quarter of its fiscal year ended September 26, 2009. Perrigo’s net sales shot up 16% to $528 million, with its store brands growing nearly 13% and its over-the-counter (OTC) category growing 3%. Perrigo’s consumer healthcare division—which supplies more than 15 categories and 500 formulas including OTC remedies, dietary supplements and nutritional drinks—added $71 million in new sales for the quarter, an increase of 19%.
