1. Fall Protection: Failure is Not an Option

Despite special emphasis programs from OSHA and increasingly sophisticated fall protection equipment, falls from heights remain a serious occupational safety challenge. In 2006, the Bureau of Labor Statistics (BLS) reported that fatal work injuries involving falls increased 5 percent after a sharp decrease in 2005. The 809 fatal falls in 2006 represent the third highest total since 1992, when the fatality census began. Fatal falls from roofs increased from 160 fatalities in 2005 to 184 in 2006, a rise of 15 percent.

2. Fall Hazard at Mass. Worksite Leads to $70,000 in OSHA Fines

OSHA has cited Shawnlee Construction Inc. for an alleged willful violation of fall protection safety standards and proposed a $70,000 fine against the Plainville, Mass., wood framing contractor. The citation and proposed penalty follow an OSHA inspection at a building under construction in Chelsea, Mass.

3. Eighth Circuit Overrules Review Commission in OSHA/Summit Multi-Employer Case

The U.S. Court of Appeals for the Eighth Circuit, in a 2-1 decision, ruled that in the case of Solis v. Summit Contractors Inc., OSHA regulation 29 C.F.R. Sec. 1910.12(a) “is unambiguous in that it does not preclude OSHA from issuing citations to employers for violations when their own employees are not exposed to any hazards related to the violations.” Therefore, according to the ruling, the Occupational Safety and Health Review Commission (OSHRC) “abused its discretion in determining that the controlling employer citation policy conflicted with the regulation.”

4. Create a Safer Work Environment by Bridging the Language and Culture Gap

In recent years, construction, manufacturing, meat packing, hospitality and many other industries have seen a sharp rise in the number of Latino, Eastern European and Asian workers. In fact, one in every two new workers is an immigrant, and one-third of those workers are from Mexico.

5. New Standard Project to Protect Workers in Wind Generation Construction Operations

The American Society of Safety Engineers (ASSE) recently announced a new A10 Accredited Standards Committee (ASC) standard project to protect the safety and health of workers involved in construction and demolition operations for wind generation/turbine facilities.

6. OSHA Cites Bloomer, Wis., Excavator for Safety Violations During Trenching Job

In September 2008, OSHA opened an inspection at the excavation jobsite in Weston after an agency inspector observed employees exposed to cave-in hazards while working in an 8-foot-deep, unprotected trench. As a result of the inspection, OSHA issued six instance-by-instance willful citations to the company for failing to protect employees from cave-in hazards, and five instance-by-instance willful citations for failing to set the spoil pile material excavated from the trench 2 feet or more from the edge of the excavation.
